Terms and conditions for participation in games, competitions and prize draws.

THE FOLLOWING TERMS AND CONDITIONS FORM THE BASIS OF PARTICIPATION IN GAMES, COMPETITIONS AND PRIZE DRAWS AS WELL AS ANY FREE SAMPLES OF GOODS (INCLUDING THE SAMPLE BOX) – HEREINAFTER REFERRED TO AS THE “PROMOTION” – AT CAFÉ ROYAL.

PARTICIPANTS MUST BE AT LEAST 18 YEARS OLD.

THESE TERMS AND CONDITIONS APPLY TO ALL PARTICIPATING RESIDENTS IN SWITZERLAND. PLEASE ENSURE YOU READ AND FULLY UNDERSTAND THESE CONDITIONS OF PARTICIPATION, AS BY PARTICIPATING YOU CONFIRM YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT ENTER THE COMPETITION.

General conditions for participation

2. Eligibility to participate

Entry to this competition is open only to persons residing in Switzerland aged 18 and above. Employees who have been involved in the preparation of the Promotion, as well as their family members, are ineligible to participate in the Promotion.
Only one entry per person is allowed and only with correct information. The organiser is entitled to exclude from the Promotion any participants using a pseudonym, a false identity or participating with multiple registrations.

3. No obligation to purchase

No purchase is necessary to take part in the Promotion.

4. Access for participation

Participation in the Promotion is only possible online via the Café Royal website, www.cafe-royal.com. Participants must visit the website via their own access media.

5. Management of prizes

An agency authorised by Delica AG will be responsible for managing the prizes. Details of the person to be contacted at the agency will be provided by Delica AG when the winners are notified.
If necessary, or in case of any event arising due to reasons beyond its control, the organiser reserves the right to partly or fully substitute prizes with another prize (or other prizes) of an equivalent or superior value.
The prizes cannot be replaced or exchanged for cash. Prizes are not transferable to third parties.

6. Exclusion of liability

The organiser is not liable for prizes that do not reach the winner due to events beyond the organiser’s control. Participants must ensure that all information they provide is correct and accurate. Delica AG is not liable for the failure to deliver prizes due to incorrect information or undeliverable e-mails.

The organiser is not liable for the use of any network, computer, material or software not associated with Delica AG, or any failure of these elements, which could limit or delay the submission or receipt of your entry or any of the prizes.
Except in the event of death or injury resulting from their own negligence, or in the case of fraud, and to the extent permitted by law, the organiser and its associated companies and agents are absolved from any responsibility or obligation resulting from:

(a) the postponement or cancellation of the competition due to events beyond the control of Delica AG;
(b) modification, passing on or use of the prize by a third party;
(c) action or lack of action by any third-party supplier.

In addition, liability is excluded in general for all incidents occurring in circumstances which are outside the organiser’s responsibility.

7. Forfeiture of prizes

If a winner does not claim or accept their prize, regardless of the reasons, or if he or she cannot be contacted within a period of three months after the prize draw, they will forfeit their prize.

8. Fraudulent participation

Participants will be immediately excluded from the Promotion in the event of fraud, if using a fictitious name or the name of a third party, or in the event that information on the entry form is incorrect, illegible, invalid or incomplete or in the event of any infringements of these terms and conditions.

The organiser also reserves the right to exclude participants from the competition when abuse or violation of these terms and conditions is suspected and/or detected.

9. Exclusion of legal process

The judges’ decision is final. No correspondence will be entered into, except to notify the winners.

10. Use of data 

The organiser will only use the personal data of participants for processing and administrating the Promotion and for commercial communication.

By participating in this competition, participants agree to allow the organiser to store, filter, access, process and transmit their competition data to third parties connected to Delica AG as well as to use this in the context of their participation in the Promotion. Participants must send a written statement to the organiser if they want to exercise their rights of access, correction and opposition.
The organiser has the right (but not the obligation), within the framework of the Promotion, to publish the name of the winner of the first prize in an anonymous form (for example, Michel D. from Bern) as well as their description (including photo) on Café Royal’s website and Facebook page.

11. Cancellation, alteration or postponement of the Promotion

In cases of acts of God, unauthorised intervention/manipulation by a third party, technical failure or any other reason beyond the organiser’s control, or in the event that the website or any of its components are shut down, the organiser is entitled to make modifications at any time or to cancel, suspend or prematurely terminate the competition.

12. Legal jurisdiction

This Promotion and any legal disputes or claims arising from or related to it are subject to Swiss legislation. In entering the competition, participants accept sole Swiss jurisdiction for any related legal disputes or complaints arising out of the competition.
The judges’ decision is final. No correspondence will be entered into, except to notify the winners.
